It's private. Your freedom of speech allows you to guy and buy a website and say whatever the F you want on it. No one can take it down. But get this... actually that's not accurate. Of course the law can take it down if it's breaking it (child porn or whatever)... BUT also the company that you PAY to host the site can remove it. If they decide that they don't like your content they can pull your website. You DON'T have freedom to use THEIR private property to do whatever you want.

Even with MY server in MY HOUSE I can still get shut down. If Cox doesn't like what I have on it, they can order me to take it down. Sure depending on the content I have recourse and COULD sue them (and probably win)... BUT there is content in which they could say "no, we don't allow that" and they would likely win in the court of law.
